is a great way of attracting relevant visitors!

Webmaster (Mark Kaufman): Would you recommend no following the sorting links?
Google Expert (John Mueller) : : Mark, if those
links lead to duplicate content, you can either add a nofollow to the links
or block indexing through meta tags or a robots.txt entry.

Webmaster (erik) : One of my clients has a thumbnail next to their serp result instead of the
sitelinks that were there before….what gives?
Google Expert (MattD) : : erik, Sitelinks
and Universal Search results are query-specific.

Webmaster (Terence): If RSS feeds have near identical content as HTML pages, might that cause duplicate
content penalties?
Google Expert (John Mueller) : : RSS feeds
do not need to be indexed, you can block indexing through your robots.txt

Webmaster (ali merchant): how does the search engine treat an https (secure) page versus an http
Google Expert (John Mueller) : : Ali, we treat
https the same as http — however, https puts a bigger load on your server,
so you might want to check that it can handle it on your side.

Webmaster (Mark Kaufman) : Kind of depends on what duplicate content means — if the sort is different
on a results screen, different products/items will appear on a given page…but
overall it’s the same set of products as the default sort.
Google Expert (John Mueller) : : Mark, if the
content is generally the same but just in a different order, I don’t think
it would provide much original value in the search results for the user.

Webmaster (Carlos) : We are a comparison shopping website, healthpricer.com, and we power the ecommerce
section of 4 different sites, i.e. marketplace.healthcentral.com those sites
have identical content to our main site, can this get me penalized?
Google Expert (Susan Moskwa) : : Unfortunately
we can’t do individual reviews for every site, but you could start here: http://www.google.com/support/webmasters/bin/answer.py?answer=66359

Webmaster (Terence) : Confusion about robots.txt vs rel=nofollow. I don’t want to pass PageRank
to my Privacy Policy. Suppose I already blocked /privacy/ in my robots.txt.
Do I also have to use rel=nofollow when linking internally to /privacy/ to
prevent the pass of PageRank?
Google Expert (Susan Moskwa) : : Pages that
are blocked by robots.txt can still have and pass PageRank, so if you don’t
want that page to get PageRank from your Privacy Policy page, you should nofollow
that link.

Webmaster (Terence): Confusion about robots.txt vs rel=nofollow. I don’t want to pass PageRank
to my Privacy Policy. Suppose I already blocked /privacy/ in my robots.txt.

the site Wysz was talking about was learningguitarnow.com

Webmaster (erik) : my client has the same issue as this: search for buzznet.com in google and
you’ll see the same thing
Google Expert (MattD) : : Thanks for
the example erik. This site is triggering an image as a Universal result.
Both Universal and Sitelinks are determined algorithmically, so you can’t
opt-in to either. You can opt out of Sitelinks in Webmaster Tools if that
helps the situation.

Webmaster (Andrew) : What are your views on image replacement versus using alt= on an image. Is
it a bad thing if used legitimately?
Google Expert (Susan Moskwa) : : There are
many high-quality sites that use image replacement techniques (such as Fahrner
image replacement) to provide a better user experience. If you’re using this
technique in a legitimate way to benefit your users, you shouldn’t have problems.

Webmaster (Nancy) : Any chance that Google will develop its own directory that folks can directly
submit their website to?

Google Expert (Evan) : : Hi Nancy,
we use the ODP (open directory project), to learn more go to dmoz.org

Webmaster (Mark Kaufman) : Can I ask a video sitemap question? We sumbitted a video sitemap back on Feb
19th. In Webmaster Tools, total URL is 11k, but Indexed URLs are 0. Of the
115 sitemaps off the index, 2 have warnings. Do video sitemaps just take a
long time to get indexed?
Google Expert (John Mueller) : : Video sitemaps
take some time to get approved — it can take up to 2-3 months.

Webmaster (Jaan Kanellis) : So duplicate content can cause page rank issues? I thought you were able to
filter duplicate content?
Google Expert (JonathanSimon) : : If you have
mutiple URLs for the same content within your site, each URL could be attracting
it’s own links. It would be better to instead have one page for everyone to
link to thus consolidating the value of all the external links.

Webmaster (Gary Carpenter) : I setup a webmaster account an submitted my url. I also setup a Sitemap.xml
file. Google reports that the url is indexed and the Sitemap file is OK yet
when I google search my url the result is “No Documents Found”.
What have I done wrong???

Google Expert (John Mueller) : : It can take
a bit for sites to get indexed, you might want to post in the webmaster help
groups for detailed suggestions.

Webmaster (Korpis, LLC) : Would there be a problem with doing a large number of 301 redirects at once?
Google Expert (Susan Moskwa) : : I would recommend
against doing “chained” redirects (a page redirects multiple times).

Webmaster (Kevin Rogers) : For the Guitar lesson site, shoule they 301 the learnguitarnow.com/index.shtml
page to learnguitarnow.com?
Google Expert (John Mueller) : : If that URL
is not linked, it should not need to be redirected. If it’s linked, it would
be best to remove the links, a 301 could help to speed up the removal.

Webmaster (Laurent) : I see nofollow links in my GWC. Why is that ?
Google Expert (John Mueller) : : That’s by
design.

Webmaster (Hasit Ruparel) : I have alread reviewed that, however I have problems in which my websites
are not considered for higher ranking, ever after following all the steps
on http://www.google.com/support/webmasters/bin/answer.py?answer=35769

want to post about it in detail in the help groups.

Webmaster (Terence) : Thanks Susan, but I’m actually asking about internal links pointing *to* /privacy/,
not links from /privacy/. Will internal links pass PR to /privacy/ even if
/privacy/ is blocked by robots.txt?
Google Expert (Susan Moskwa) : : Yes.

for your question. We’re now discussing images in Google Search results

Webmaster (Jaan Kanellis) : Also can we get any comments on paid link re-inclusion process? Once the paid
links are removed is the next step Google re-inclusion through Google Webmaster
Tools?

Google Expert (John Mueller) : : Yes, a reconsideration
request is the next logical step once everything is cleaned up. Please include
all details in your request so that we can handle it appropriately.

Webmaster (Allison Kulage) : Related to the robots.txt issue – if you’ve placed a no robots tag on every
page of a site and a disallow for all in the robots.txt file, but the home
page still shows up in the top 10 for a competitive keyword, how else can
you get the site removed?
Google Expert (John Mueller) : : If you are
blocking crawling with robots.txt, we won’t be albe to see the robots meta
tag. If you want the URL removed, it would be better to allow crawling (not
block it in a robots.txt) so that the meta tag can be read.

Webmaster (Raffi) : would you suggest subdomains or folders for state specific content for a US
site? i.e. az.domain.com or www.domain.com/az ?
Google Expert (John Mueller) : : Both work.

Webmaster (Cassiano Travareli) : i wanna know about duplicate content inside blogs. about categories, archives,
authors, have the same content of the article. in my webpages im blocking
using robots txt, i blocked categories and archives. is it good?
Google expert (MattD) : : Cassiano, If your content is the original, I wouldn’t recommend
blocking it. If you have content fed in from another site, it might be smart
to use robots.txt as you’ve said. I’d recommend taking your site to the Webmaster
Help Group as well.

Webmaster (Terence) : What are the benefits of submitting a sitemap if our site is already crawled
well by Google? In other words, what are we missing out if we don’t submit
a sitemap?

Google Expert (John Mueller) : : By submitting
a Sitemap we see which URLs have been added and changed. We can crawl those
earlier than if we had to accidentally “stumble” upon them.

Webmaster (Jaan Kanellis) : Lastly can we download this cat log?
Google Expert (John Mueller) : : You should
be able to use File – Save to save this log.

Webmaster (Rob) : Is there any major issue with using CMS, e.g. Joomla?
Google Expert (John Mueller) : : If the CMS
is compliant with the normal web standard it should be no problem. However,
each tool is only as strong as the person using it — all CMS can create great
sites and they can create bad sites.

Google Expert 2 (MattD) : : Rob, from personal experience, CMS packages are great, though
you will want to make sure you customize the templates and page titles so
your snippets are unique.

Webmaster (Phil Peterman) : I was hoping y’all would address the use of display:none and some basic guidelines
for it’s use
Google Expert (JonathanSimon) : : As long as
the use of display:none is not abused to selectively hide content from site
visitors while at the same time showing it to search engine crawlers, it should
fine to use this.

but use rel=”nofollow” in all of its external links?

could you clarify? Good Site A links to Good Site B, and Good Site B has rel=”nofollow”
links?

best to put this content online, though I’m not yet sure in what format.

Webmaster (Leslie Ding) : Regarding subdomains, I understand google can determine country codes from
the URL, e.g. jp.mysite.com. What about japan.mysite.com?
Google Expert (John Mueller) : : No those are
not recognized automatically. You can however use Webmaster Tools to set geotargeting
for it.

“for us” to try and get your google bomb algo to kick in…what
can I do about this?
Google Expert (John Mueller) : : That’s generally
no problem as we always look at the bigger picture and try to assess the intent.

Webmaster (John) : One or two panelist mentioned they were part of the google health team, but
I did not catch their names?
Google Expert (Adam Lasnik) : : Hi John, nope,
sorry, we must not have spoken clearly… — we’re all in Search Quality,
not Health

Webmaster (ParksC) : With regards to the paid links question above about asking for inclusion,
would it be the same to nofollow the paid links instead of just having them
removed?
Google Expert (John Mueller) : : Yes, if you
had paid links and added rel=nofollow to them, you can explain that in your
reconsideration request.

Webmaster (Nancy) : Yes, I’ve been trying for 2 years to get a listing, but there is no editor
for my category… so things have been slow. I guess I thought that Google
might be a bit quicker in adding entries. That said, I’ve had good luck in
getting my site listed.

Google Expert (Susan Moskwa) : : It sounds
like you’re talking aboutGoogle Directory, which our team doesn’t really
work with. If you’re referring to Google search results, there isn’t an “editor”
process to get in. Check out our Webmaster Guidelines for help getting into
search results.

Webmaster (Terence) : We have a regional sudomain, canada.domain.com (we don’t have domain.ca).
We set the geo location to Canada in Google Webmaster Tools a few weeks ago,
but site is still not indexed as a Canadian site. How long does it take? Any
other steps we should take?

Google Expert (John Mueller) : : This can take
some time to take affect. If the setting is set, you should be fine in the
long run.

Webmaster (Terence) : Does Google rank “static” URLs better than dynamic URLs? Ex. /q-digital-camera.html
vs /search?q=digital+camera

Google Expert (John Mueller) : : There’s no
preference.

Webmaster (paavan) : When can available option pay per call in India
Google Expert (ramya) : : You can post
your question with respect to Pay per call on http://groups.google.com/group/adwords-help,they
should be able to help you better

Webmaster (Jeremy Rivera) : Will Universal Image search results REPLACE links to sites? I.e. Instead of
10 sites plus images, will we see 1 image, 1 video and 8 sites?
Google Expert (Susan Moskwa) : : We’re constantly
testing what works well in our search results, including whether differenty
types of universal results are “additive” or will replace one of
the 10 web results. For now I’d say, stay tuned.

Webmaster (Richard Hearne) : Is there any process for confirming a TBPR penalty? Working with authority
site which recently went PR7 -> PR3
Google Expert (John Mueller) : : If you know
that the site did not comply with the webmaster guidelines, you can clean
that up and file a reconsideration request.

Webmaster (webado – Christina) : I don’t know where I can ask my question if I may even – down hre or up there
or nowhere ?

Webmaster (jtbandes) : How about <meta name=”keywords”>? Worth it? Or just let the
search engines get it from the content?
Google Expert (John Mueller) : : We do not
read the keywords meta tag — but if you want to use it for yourself, feel
free to keep them.

Webmaster (Amit Agarwal) : One of my sites was severly penalized in Google though it respects all the
guidelines. I filed a reconsideration request and it was quicklrestored though
I didn’t change anything at my end. The problem has happened thrice in 3 months..
Can I prevent this ?

Google Expert (MattD) : : Amit, reconsideration
requests are the right path. You may want to set up a Webmaster Tools account
to check the message center if you haven’t already.

Webmaster (Tom Smith) : Our site is CSS based, content pages are heirarchy based, using 2 <h1>
tags, 2 <h2> tags and then <h3> tags for additional content sections
to organize content sections. Will we be penalized using this approach?
Google Expert (John Mueller) : : That’s a great
way to provide context to your content. Keep it up!

Webmaster (Andrew Delamarter) : Is it possible sap.com is being penalized on Google.com by the geo-relevancy
component due to the site being hosted on servers in germany, japan, and the
US? Load balancing determines which data center handles the session.

Google Expert (John Mueller) : : By setting
the geotargeting in webmaster tools the server location will be less of an
impact. We understand the need for load sharing across locations.

Webmaster (ali merchant ) : Concerned about div tags. Any harm if they are used as a space saving technique
and used completely legitmately
Google Expert (MattD) : : ali, There
should be no harm in extra div tags if they are being used legitimately. Let
me know if this doesn’t answer the question.

Webmaster (webado – Christina) : OK here goes. This site melinas-music.com – starts out with an optional flash
splash page which redirects (in flash) to the proper homepage whihc with js
on is a /home/. With js off you dont’ get the splash flash and the page displayed
at the root url
Google Expert (John Mueller) : : That should
not be a problem .

Webmaster (webado – Christina) : is the same as would be at /hom/ which is not accessible except though js.
Google Expert (John Mueller) : : If users can
link to it, they probably will sooner or later. In general it’s no problem
if it’s just a duplicate.

Webmaster (Christi) : Should we use alt and title tags, or just alt tags, on images?
Google Expert (John Mueller) : : You can use
both, since the title tag is shown as a tool tip in Firefox, but the alt text
is more of a replacement for the image — they’re two different things, which
can be used at the same time.

Webmaster (Jaan Kanellis) : John can you confirm that www.websitehostdirectory.com has been hit with a
paid link penalty? So I can remove them and do a re-inclusion?

Google Expert (John Mueller) : : Hi Jaan, we
can’t discuss individual sites here, but you may try the experts in the Google
Webmaster Help groups.

Webmaster (Alan Rothstein) : What about the image enhancement function in Google Webmaster Tools, how does
this help?

you right now. No automatic boost, but a program to help us understand images
better.

page in a hidden div and set to the proper div after loading for help search
engines not see the common content first. Is this OK ?
Google Expert (John Mueller) : : That’s fine,
if it works for the users and if the content shown / hidden is not misleading
to search engines.

from the index? or can you submit if you’ve seen a huge drop in rankings but
you’re still in the index? What if only a few pages got dropped?

reconsideration at any time, if you’ve seen a sudden and significant change
in your site’s performance.

Webmaster (Mark Kaufman) : Does using an image caching/delivery network, like Akamaii, where the host
doman of the image is different than the web page, a problem forGoogle image
search?

Google Expert (John Mueller) : : The host domain
does not have to be the same as the web page – it’ll still be indexed in the
context of the web page.

Webmaster (Korpis, LLC) : Does google better understand a page if the url contains the major keywords
the page is about?
Google Expert (Evan) : : If the subject
of the page is already adequately covered, then search engines will understand.
Having the keywords in the URL will help your users understand what to expect
on the page.

Webmaster (Leslie Ding) : I noticed that in Google News, the thumbnail is from a different site to the
news content. How does Google determine what image thumbnail is paired with
a google news entry?

Google Expert (John Mueller) : :Google News
has a completely different setup than normal web search. The help center has
more information on Google news and News Sitemap files.

Webmaster (Mark) : Our site has a number of categories and within each category products are
shown 9 thumbnails at a time. It seems that our category names come up great
in the search results, but products below the first nine in a category do
not appear well.
Google Expert (JonathanSimon) : : I’ve seen
similar situations as this where the problem turned out to be how the product
pages were linked using a Javascript method instead of a standard HREF link.
Another thing to consider is if the product pages have unique content..check
web for dups

Webmaster (Gary Campbell) : I mean, we load menus at end of page, move to top of page via script. Is this
OK ?
Google Expert (John Mueller) : : Should be
ok, if it’s not misleading.

Webmaster (Charlie) : Should I rather have HTML drop downs to all the 50 categories on my website,
or should i rather have the top 5 category links on my front page
Google Expert (Susan Moskwa) : : I’d recommend
thinking about it from a user perspective. If you were a new visitor to your
site, which method of organization would be easier for you to use?

Webmaster (webado – Christina) : the page at /home/ is kept out of the index
Google Expert (John Mueller) : : that should
be ok.

Webmaster (Brian Harnish) : Does Google have plans to include programming algorithms that provide higher
results for W3C standards-compliant sites as well as great content?

Google Expert (John Mueller) : : If your site
has compliant code then that could increase your number of happy visitors
– which could in turn help your site across the board.

Webmaster (Gijs Nelissen) : are we able to listen to a recording of this conference ?
Google Expert (Evan) : : Unfortunately
we do not have an audio recording of this chat. There should be some people
blogging about it .

Webmaster (ali merchant) : can subdomains increase my visibility
Google Expert (MattD): : ali, pages
on subdomains should not increase visibility any more than pages on subdirectories.
It’s more of an organization (and sometimes navigation) preference.

Webmaster (Felipe Miyata) : does a noindex, follow page pass pagerank?
Google Expert (Evan) : : Noindex pages
accrue Google PR, and can pass Google PR – even though as a page in its own
right, it does not exist in the SERP’s – a good use for this would be pages such as sitemaps that you don’t want
to appear in the SERP’s, but that you want to accrue

Webmaster (Allison Kulage) : If there’s a paid links penalty, what’s to stop my competition from buying
paid links to get my site penalized? And, many of the top rankings sites for
a client of mine are breaking all the paid link rules. How are they ranking
and my site isn’t?
Google Expert (John Mueller) : : If you feel
that a different site is buying / selling links, you can report that in WEbmaster
Tools. This helps us fine-tune our algorithms. In the end, we will take a
look at the broader picture.

Webmaster (Terence) : We have a very large site with tons of dynamically created pages (like user

the original content providers get the orginial value?

is syndicated, you might want to make sure that you have a link back to your

paid links, you need to make sure that they do not pass pagerank. If you can

Webmaster (ali merchant) : Matt, if a site is hosted internationally, its preferred to use a top level
domain extension such as .co.uk, however wont that affect traffic within the
US though.

I see. If you have a country-specific TLD, you are inherently already targeting
a region. If you have a generic TLD, you can use the geolocation feature in
Webmaster Tools to specify either a subdomain or subdirectory as targeted
to a country.

Webmaster (Amit Agarwal) : I have seen aggregators like megite.com, social sites like Digg and even splogs
rank above in Google than the actual webpage. Can we prevent this ?

many factors involved in ranking — for details, you may want to ask the experts
in the Webmaster Help groups.

Webmaster (Dictina) : I want to make some case conversion of my URLs in order to have all them in
minor case and avoid duplicates, , but I am afraid of overloading the server
with 301 redirection. Any idea to make efficient redirects?
Google Expert (John Mueller): : In general
even a large number of 301 redirects will not be a problem in the long run.
One way you can help that is by using a Sitemap file.

Webmaster (webado – Christina) : I think it does. All it is js on, you get splash and redirect to /home/; js
off you stay on root but see what woudl have been at /home/
Google Expert (John Mueller) : : If you have
cleaned up the links to your site as much as possible, make sure that you
detail what you did and file a reconsideration request. However, make sure
that all of your site complies with all of the guidelines beforehand.

Webmaster (Doug) : What would be the process if you feel google thinks you have paid links but
you do not
Google Expert (Wysz) : : If you feel
that your site may have been detected as being in violation of the Webmaster
Guidelines and it is not (or is no longer), then submitting a reconsideration
request in Webmaster Tools is the way to go.

Webmaster (ParksC) : again with asking for inclusion, would you need to wait until Google has recrawled
any/all sites you have had paid links changed on before asking? And how long
would you expect to wait to see results from asking for inclusion?

Google Expert (John Mueller) : : If you have
cleaned up the links to your site as much as possible, make sure that you
detail what you did and file a reconsideration request. However, make sure
that all of your site complies with all of the guidelines beforehand.

Webmaster (Amy Balliett) : I have reported a competitor for spam multiple times (they use CSS to push
about 50 repeated keywords off the screen on load). I’ve seen nothing happen
as a result of my spam report, is there a better way to report this?
Google Expert (Susan Moskwa) : : The spam
report is the best way to do this. FYI we do take all spam reports into account,
but we don’t take immediate manual action on all of them (we use many of them
to improve our algorithms in the long term), so you may not see immediate
changes.

Webmaster (Gabe) : It sounds like you are big on blogs. How would you rank the blog software
out there (wordpress, blogge, etc.) in terms of which has the most SEO friendly
coding so that we can best succeed in search results?

to link to a site that you either don’t trust or can’t vouch for use rel nofollow.
For user generated content like the comments section of a blog, user added
URLs can be auto nofollowed if you don’t have time to monitor these Links

Google Expert (John Mueller) : : You should
make sure that the redirecting URLs cannot be crawled, then you should be
ok.

.com domain is a generic top-level domaina, while .in is a country-specific
domain. While they could appear mixed in the serps, the .in domains would
be naturally better targeted for India-specific local queries

Webmaster (Manish) : Does the country where your .in domain is hosted makes any difference in SERPs
Google Expert (Evan) : : Hi Manish,
this may affect different geographical google domains, such as google.co.uk
or google.com. I would suggest using WM Tools to set geolocation preferences.

Webmaster (Doug) : Spam reports are good but i think that some type of reputation should be given
to them based on how man someone does maybe

spam reports, make sure that you do that from within your webmaster Tools
account. Those reports are treated with higher priority.

I think that the majority of sites would benefit more from spending their
time and energy on other things (making sure the site’s content is accessible,

true? If your tld is already a country tld then that’s the geolocaiton already

I’ll try to cover this while Adam talks. If you think about this in the
same way as images, a descriptive file name can be more helpful than a non-descriptive
filename for users and search engines.

Google Expert (John Mueller) : : Yes, but
it will not pass as much context for image search as an image that is embedded
in a HTML page.

Webmaster (Dictina) : Tags vs categories navigation or pagination: which is best? which shoul <I
nofollow?

to you how you want to have users navigate your pages, both can work well.
I would suggest using nofollow on links that you do not want to pass PageRank
(links that are unrelated to your website, etc)

Webmaster: How would you rate the importance of <title> tags?
Google Expert: : Title tags
are important for users to understand what to expect on your website.Google
will serve your title tag in the results page, and you want your users to
have a clear understanding of where they are going.

some of the same content on the main site. How do I get ranked on mobile devices

bahwa pembangunan nasional adalah suatu proses yang berkelanjutan yang harus senantiasa tanggap terhadap berbagai dinamika yang terjadi di masyarakat;
bahwa globalisasi informasi telah menempatkan Indonesia sebagai bagian dari masyarakat informasi dunia sehingga mengharuskan dibentuknya pengaturan mengenai pengelolaan Informasi dan Transaksi Elektronik di tingkat nasional sehingga pembangunan Teknologi Informasi dapat dilakukan secara optimal, merata, dan menyebar ke seluruh lapisan masyarakat guna mencerdaskan kehidupan bangsa;
bahwa perkembangan dan kemajuan Teknologi Informasi yang demikian pesat telah menyebabkan perubahan kegiatan kehidupan manusia dalam berbagai bidang yang secara langsung telah memengaruhi lahirnya bentuk-bentuk perbuatan hukum baru;
bahwa penggunaan dan pemanfaatan Teknologi Informasi harus terus dikembangkan untuk menjaga, memelihara, dan memperkukuh persatuan dan kesatuan nasional berdasarkan Peraturan Perundang-undangan demi kepentingan nasional;
bahwa pemanfaatan Teknologi Informasi berperan penting dalam perdagangan dan pertumbuhan perekonomian nasional untuk mewujudkan kesejahteraan masyarakat;
bahwa pemerintah perlu mendukung pengembangan Teknologi Informasi melalui infrastruktur hukum dan pengaturannya sehingga pemanfaatan Teknologi Informasi dilakukan secara aman untuk mencegah penyalahgunaannya dengan memperhatikan nilai-nilai agama dan sosial budaya masyarakat Indonesia;

BAB I

KETENTUAN UMUM

Pasal 1

Dalam Undang-Undang ini yang dimaksud dengan:

Informasi Elektronik adalah satu atau sekumpulan data elektronik, termasuk tetapi tidak terbatas pada tulisan, suara, gambar, peta, rancangan, foto, electronic data interchange (EDI), surat elektronik (electronic mail), telegram, teleks, telecopy atau sejenisnya, huruf, tanda, angka, Kode Akses, simbol, atau perforasi yang telah diolah yang memiliki arti atau dapat dipahami oleh orang yang mampu memahaminya.
Transaksi Elektronik adalah perbuatan hukum yang dilakukan dengan menggunakan Komputer, jaringan Komputer, dan/atau media elektronik lainnya.
Teknologi Informasi adalah suatu teknik untuk mengumpulkan, menyiapkan, menyimpan, memproses, mengumumkan, menganalisis, dan/atau menyebarkan informasi.
Dokumen Elektronik adalah setiap Informasi Elektronik yang dibuat, diteruskan, dikirimkan, diterima, atau disimpan dalam bentuk analog, digital, elektromagnetik, optikal, atau sejenisnya, yang dapat dilihat, ditampilkan, dan/atau didengar melalui Komputer atau Sistem Elektronik, termasuk tetapi tidak terbatas pada tulisan, suara, gambar, peta, rancangan, foto atau sejenisnya, huruf, tanda, angka, Kode Akses, simbol atau perforasi yang memiliki makna atau arti atau dapat dipahami oleh orang yang mampu memahaminya.
Sistem Elektronik adalah serangkaian perangkat dan prosedur elektronik yang berfungsi mempersiapkan, mengumpulkan, mengolah, menganalisis, menyimpan, menampilkan, mengumumkan, mengirimkan, dan/atau menyebarkan Informasi Elektronik.
Penyelenggaraan Sistem Elektronik adalah pemanfaatan Sistem Elektronik oleh penyelenggara negara, Orang, Badan Usaha, dan/atau masyarakat.
Jaringan Sistem Elektronik adalah terhubungnya dua Sistem Elektronik atau lebih, yang bersifat tertutup ataupun terbuka.
Agen Elektronik adalah perangkat dari suatu Sistem Elektronik yang dibuat untuk melakukan suatu tindakan terhadap suatu Informasi Elektronik tertentu secara otomatis yang diselenggarakan oleh Orang.
Sertifikat Elektronik adalah sertifikat yang bersifat elektronik yang memuat Tanda Tangan Elektronik dan identitas yang menunjukkan status subjek hukum para pihak dalam Transaksi Elektronik yang dikeluarkan oleh Penyelenggara Sertifikasi Elektronik.
10. Penyelenggara Sertifikasi Elektronik adalah badan hukum yang berfungsi sebagai pihak yang layak dipercaya, yang memberikan dan mengaudit Sertifikat Elektronik.
Lembaga Sertifikasi Keandalan adalah lembaga independen yang dibentuk oleh profesional yang diakui, disahkan, dan diawasi oleh Pemerintah dengan kewenangan mengaudit dan mengeluarkan sertifikat keandalan dalam Transaksi Elektronik.
Tanda Tangan Elektronik adalah tanda tangan yang terdiri atas Informasi Elektronik yang dilekatkan, terasosiasi atau terkait dengan Informasi Elektronik lainnya yang digunakan sebagai alat verifikasi dan autentikasi.
Penanda Tangan adalah subjek hukum yang terasosiasikan atau terkait dengan Tanda Tangan Elektronik.
Komputer adalah alat untuk memproses data elektronik, magnetik, optik, atau sistem yang melaksanakan fungsi logika, aritmatika, dan penyimpanan.
Akses adalah kegiatan melakukan interaksi dengan Sistem Elektronik yang berdiri sendiri atau dalam jaringan.
Kode Akses adalah angka, huruf, simbol, karakter lainnya atau kombinasi di antaranya, yang merupakan kunci untuk dapat mengakses Komputer dan/atau Sistem Elektronik lainnya.
Kontrak Elektronik adalah perjanjian para pihak yang dibuat melalui Sistem Elektronik.
Pengirim adalah subjek hukum yang mengirimkan Informasi Elektronik dan/atau Dokumen Elektronik.
Penerima adalah subjek hukum yang menerima Informasi Elektronik dan/atau Dokumen Elektronik dari Pengirim.
Nama Domain adalah alamat internet penyelenggara negara, Orang, Badan Usaha, dan/atau masyarakat, yang dapat digunakan dalam berkomunikasi melalui internet, yang berupa kode atau susunan karakter yang bersifat unik untuk menunjukkan lokasi tertentu dalam internet.
Orang adalah orang perseorangan, baik warga negara Indonesia, warga negara asing, maupun badan hukum.
Badan Usaha adalah perusahaan perseorangan atau perusahaan persekutuan, baik yang berbadan hukum maupun yang tidak berbadan hukum.
Pemerintah adalah Menteri atau pejabat lainnya yang ditunjuk oleh Presiden.

Pasal 2

Undang-Undang ini berlaku untuk setiap Orang yang melakukan perbuatan hukum sebagaimana diatur dalam Undang-Undang ini, baik yang berada di wilayah hukum Indonesia maupun di luar wilayah hukum Indonesia, yang memiliki akibat hukum di wilayah hukum Indonesia dan/atau di luar wilayah hukum Indonesia dan merugikan kepentingan Indonesia.

BAB II

ASAS DAN TUJUAN

Pasal 3

Pemanfaatan Teknologi Informasi dan Transaksi Elektronik dilaksanakan berdasarkan asas kepastian hukum, manfaat, kehati-hatian, iktikad baik, dan kebebasan memilih teknologi atau netral teknologi.

Pasal 4

Pemanfaatan Teknologi Informasi dan Transaksi Elektronik dilaksanakan dengan tujuan untuk:

mencerdaskan kehidupan bangsa sebagai bagian dari masyarakat informasi dunia;
mengembangkan perdagangan dan perekonomian nasional dalam rangka meningkatkan kesejahteraan masyarakat;
meningkatkan efektivitas dan efisiensi pelayanan publik;
membuka kesempatan seluas-luasnya kepada setiap Orang untuk memajukan pemikiran dan kemampuan di bidang penggunaan dan pemanfaatan Teknologi Informasi seoptimal mungkin dan bertanggung jawab; dan
memberikan rasa aman, keadilan, dan kepastian hukum bagi pengguna dan penyelenggara Teknologi Informasi.

BAB III

INFORMASI, DOKUMEN, DAN TANDA TANGAN ELEKTRONIK

Pasal 5

Informasi Elektronik dan/atau Dokumen Elektronik dan/atau hasil cetaknya merupakan alat bukti hukum yang sah.
Informasi Elektronik dan/atau Dokumen Elektronik dan/atau hasil cetaknya sebagaimana dimaksud pada ayat (1) merupakan perluasan dari alat bukti yang sah sesuai dengan Hukum Acara yang berlaku di Indonesia.
Informasi Elektronik dan/atau Dokumen Elektronik dinyatakan sah apabila menggunakan Sistem Elektronik sesuai dengan ketentuan yang diatur dalam Undang-Undang ini.
Ketentuan mengenai Informasi Elektronik dan/atau Dokumen Elektronik sebagaimana dimaksud pada ayat (1) tidak berlaku untuk:
1. surat yang menurut Undang-Undang harus dibuat dalam bentuk tertulis; dan
2. surat beserta dokumennya yang menurut Undang-Undang harus dibuat dalam bentuk akta notaril atau akta yang dibuat oleh pejabat pembuat akta.

Pasal 6

Dalam hal terdapat ketentuan lain selain yang diatur dalam Pasal 5 ayat (4) yang mensyaratkan bahwa suatu informasi harus berbentuk tertulis atau asli, Informasi Elektronik dan/atau Dokumen Elektronik dianggap sah sepanjang informasi yang tercantum di dalamnya dapat diakses, ditampilkan, dijamin keutuhannya, dan dapat dipertanggungjawabkan sehingga menerangkan suatu keadaan.

Pasal 7

Setiap Orang yang menyatakan hak, memperkuat hak yang telah ada, atau menolak hak Orang lain berdasarkan adanya Informasi Elektronik dan/atau Dokumen Elektronik harus memastikan bahwa Informasi Elektronik dan/atau Dokumen Elektronik yang ada padanya berasal dari Sistem Elektronik yang memenuhi syarat berdasarkan Peraturan Perundang-undangan.

Pasal 8

Kecuali diperjanjikan lain, waktu pengiriman suatu Informasi Elektronik dan/atau Dokumen Elektronik ditentukan pada saat Informasi Elektronik dan/atau Dokumen Elektronik telah dikirim dengan alamat yang benar oleh Pengirim ke suatu Sistem Elektronik yang ditunjuk atau dipergunakan Penerima dan telah memasuki Sistem Elektronik yang berada di luar kendali Pengirim.
Kecuali diperjanjikan lain, waktu penerimaan suatu Informasi Elektronik dan/atau Dokumen Elektronik ditentukan pada saat Informasi Elektronik dan/atau Dokumen Elektronik memasuki Sistem Elektronik di bawah kendali Penerima yang berhak.
Dalam hal Penerima telah menunjuk suatu Sistem Elektronik tertentu untuk menerima Informasi Elektronik, penerimaan terjadi pada saat Informasi Elektronik dan/atau Dokumen Elektronik memasuki Sistem Elektronik yang ditunjuk.
Dalam hal terdapat dua atau lebih sistem informasi yang digunakan dalam pengiriman atau penerimaan Informasi Elektronik dan/atau Dokumen Elektronik, maka:
1. waktu pengiriman adalah ketika Informasi Elektronik dan/atau Dokumen Elektronik memasuki sistem informasi pertama yang berada di luar kendali Pengirim;
2. waktu penerimaan adalah ketika Informasi Elektronik dan/atau Dokumen Elektronik memasuki sistem informasi terakhir yang berada di bawah kendali Penerima.

Pasal 9

Pelaku usaha yang menawarkan produk melalui Sistem Elektronik harus menyediakan informasi yang lengkap dan benar berkaitan dengan syarat kontrak, produsen, dan produk yang ditawarkan.

Pasal 10

Setiap pelaku usaha yang menyelenggarakan Transaksi Elektronik dapat disertifikasi oleh Lembaga Sertifikasi Keandalan.
Ketentuan mengenai pembentukan Lembaga Sertifikasi Keandalan sebagaimana dimaksud pada ayat (1) diatur dengan Peraturan Pemerintah.

Pasal 11

Tanda Tangan Elektronik memiliki kekuatan hukum dan akibat hukum yang sah selama memenuhi persyaratan sebagai berikut:
1. data pembuatan Tanda Tangan Elektronik terkait hanya kepada Penanda Tangan;
2. data pembuatan Tanda Tangan Elektronik pada saat proses penandatanganan elektronik hanya berada dalam kuasa Penanda Tangan;
3. segala perubahan terhadap Tanda Tangan Elektronik yang terjadi setelah waktu penandatanganan dapat diketahui;
4. segala perubahan terhadap Informasi Elektronik yang terkait dengan Tanda Tangan Elektronik tersebut setelah waktu penandatanganan dapat diketahui;
5. terdapat cara tertentu yang dipakai untuk mengidentifikasi siapa Penandatangannya; dan
6. terdapat cara tertentu untuk menunjukkan bahwa Penanda Tangan telah memberikan persetujuan terhadap Informasi Elektronik yang terkait.
Ketentuan lebih lanjut tentang Tanda Tangan Elektronik sebagaimana dimaksud pada ayat (1) diatur dengan Peraturan Pemerintah.

Pasal 12

Setiap Orang yang terlibat dalam Tanda Tangan Elektronik berkewajiban memberikan pengamanan atas Tanda Tangan Elektronik yang digunakannya.
Pengamanan Tanda Tangan Elektronik sebagaimana dimaksud pada ayat (1) sekurang-kurangnya meliputi:
1. sistem tidak dapat diakses oleh Orang lain yang tidak berhak;
2. Penanda Tangan harus menerapkan prinsip kehati-hatian untuk menghindari penggunaan secara tidak sah terhadap data terkait pembuatan Tanda Tangan Elektronik;
3. Penanda Tangan harus tanpa menunda-nunda, menggunakan cara yang dianjurkan oleh penyelenggara Tanda Tangan Elektronik ataupun cara lain yang layak dan sepatutnya harus segera memberitahukan kepada seseorang yang oleh Penanda Tangan dianggap memercayai Tanda Tangan Elektronik atau kepada pihak pendukung layanan Tanda Tangan Elektronik jika:
  1. Penanda Tangan mengetahui bahwa data pembuatan Tanda Tangan Elektronik telah dibobol; atau
  2. keadaan yang diketahui oleh Penanda Tangan dapat menimbulkan risiko yang berarti, kemungkinan akibat bobolnya data pembuatan Tanda Tangan Elektronik; dan
4. dalam hal Sertifikat Elektronik digunakan untuk mendukung Tanda Tangan Elektronik, Penanda Tangan harus memastikan kebenaran dan keutuhan semua informasi yang terkait dengan Sertifikat Elektronik tersebut.
Setiap Orang yang melakukan pelanggaran ketentuan sebagaimana dimaksud pada ayat (1), bertanggung jawab atas segala kerugian dan konsekuensi hukum yang timbul.

BAB IV

PENYELENGGARAAN SERTIFIKASI ELEKTRONIK DAN SISTEM ELEKTRONIK

Bagian Kesatu

Penyelenggaraan Sertifikasi Elektronik

Pasal 13

Setiap Orang berhak menggunakan jasa Penyelenggara Sertifikasi Elektronik untuk pembuatan Tanda Tangan Elektronik.
Penyelenggara Sertifikasi Elektronik harus memastikan keterkaitan suatu Tanda Tangan Elektronik dengan pemiliknya.
Penyelenggara Sertifikasi Elektronik terdiri atas:
1. Penyelenggara Sertifikasi Elektronik Indonesia; dan
2. Penyelenggara Sertifikasi Elektronik asing.
Penyelenggara Sertifikasi Elektronik Indonesia berbadan hukum Indonesia dan berdomisili di Indonesia.
Penyelenggara Sertifikasi Elektronik asing yang beroperasi di Indonesia harus terdaftar di Indonesia.
Ketentuan lebih lanjut mengenai Penyelenggara Sertifikasi Elektronik sebagaimana dimaksud pada ayat (3) diatur dengan Peraturan Pemerintah.

Pasal 14

Penyelenggara Sertifikasi Elektronik sebagaimana dimaksud dalam Pasal 13 ayat (1) sampai dengan ayat (5) harus menyediakan informasi yang akurat, jelas, dan pasti kepada setiap pengguna jasa, yang meliputi:

1. metode yang digunakan untuk mengidentifikasi Penanda Tangan;
2. hal yang dapat digunakan untuk mengetahui data diri pembuat Tanda Tangan Elektronik; dan
3. hal yang dapat digunakan untuk menunjukkan keberlakuan dan keamanan Tanda Tangan Elektronik.

Penyelenggaraan Sistem Elektronik

Pasal 15

Setiap Penyelenggara Sistem Elektronik harus menyelenggarakan Sistem Elektronik secara andal dan aman serta bertanggung jawab terhadap beroperasinya Sistem Elektronik sebagaimana mestinya.
Penyelenggara Sistem Elektronik bertanggung jawab terhadap Penyelenggaraan Sistem Elektroniknya.
Ketentuan sebagaimana dimaksud pada ayat (2) tidak berlaku dalam hal dapat dibuktikan terjadinya keadaan memaksa, kesalahan, dan/atau kelalaian pihak pengguna Sistem Elektronik.

Pasal 16

Sepanjang tidak ditentukan lain oleh undang-undang tersendiri, setiap Penyelenggara Sistem Elektronik wajib mengoperasikan Sistem Elektronik yang memenuhi persyaratan minimum sebagai berikut:
1. dapat menampilkan kembali Informasi Elektronik dan/atau Dokumen Elektronik secara utuh sesuai dengan masa retensi yang ditetapkan dengan Peraturan Perundang-undangan;
2. dapat melindungi ketersediaan, keutuhan, keotentikan, kerahasiaan, dan keteraksesan Informasi Elektronik dalam Penyelenggaraan Sistem Elektronik tersebut;
3. dapat beroperasi sesuai dengan prosedur atau petunjuk dalam Penyelenggaraan Sistem Elektronik tersebut;
4. dilengkapi dengan prosedur atau petunjuk yang diumumkan dengan bahasa, informasi, atau simbol yang dapat dipahami oleh pihak yang bersangkutan dengan Penyelenggaraan Sistem Elektronik tersebut; dan
5. memiliki mekanisme yang berkelanjutan untuk menjaga kebaruan, kejelasan, dan kebertanggungjawaban prosedur atau petunjuk.
Ketentuan lebih lanjut tentang Penyelenggaraan Sistem Elektronik sebagaimana dimaksud pada ayat (1) diatur dengan Peraturan Pemerintah.

BAB V

TRANSAKSI ELEKTRONIK

Pasal 17

Penyelenggaraan Transaksi Elektronik dapat dilakukan dalam lingkup publik ataupun privat.
Para pihak yang melakukan Transaksi Elektronik sebagaimana dimaksud pada ayat (1) wajib beriktikad baik dalam melakukan interaksi dan/atau pertukaran Informasi Elektronik dan/atau Dokumen Elektronik selama transaksi berlangsung.
Ketentuan lebih lanjut mengenai penyelenggaraan Transaksi Elektronik sebagaimana dimaksud pada ayat (1) diatur dengan Peraturan Pemerintah.

Pasal 18

Transaksi Elektronik yang dituangkan ke dalam Kontrak Elektronik mengikat para pihak.
Para pihak memiliki kewenangan untuk memilih hukum yang berlaku bagi Transaksi Elektronik internasional yang dibuatnya.
Jika para pihak tidak melakukan pilihan hukum dalam Transaksi Elektronik internasional, hukum yang berlaku didasarkan pada asas Hukum Perdata Internasional.
Para pihak memiliki kewenangan untuk menetapkan forum pengadilan, arbitrase, atau lembaga penyelesaian sengketa alternatif lainnya yang berwenang menangani sengketa yang mungkin timbul dari Transaksi Elektronik internasional yang dibuatnya.
Jika para pihak tidak melakukan pilihan forum sebagaimana dimaksud pada ayat (4), penetapan kewenangan pengadilan, arbitrase, atau lembaga penyelesaian sengketa alternatif lainnya yang berwenang menangani sengketa yang mungkin timbul dari transaksi tersebut, didasarkan pada asas Hukum Perdata Internasional

Pasal 19

Para pihak yang melakukan Transaksi Elektronik harus menggunakan Sistem Elektronik yang disepakati.

Pasal 20

Kecuali ditentukan lain oleh para pihak, Transaksi Elektronik terjadi pada saat penawaran transaksi yang dikirim Pengirim telah diterima dan disetujui Penerima.
Persetujuan atas penawaran Transaksi Elektronik sebagaimana dimaksud pada ayat (1) harus dilakukan dengan pernyataan penerimaan secara elektronik.

Pasal 21

Pengirim atau Penerima dapat melakukan Transaksi Elektronik sendiri, melalui pihak yang dikuasakan olehnya, atau melalui Agen Elektronik.
Pihak yang bertanggung jawab atas segala akibat hukum dalam pelaksanaan Transaksi Elektronik sebagaimana dimaksud pada ayat (1) diatur sebagai berikut:
1. jika dilakukan sendiri, segala akibat hukum dalam pelaksanaan Transaksi Elektronik menjadi tanggung jawab para pihak yang bertransaksi;
2. jika dilakukan melalui pemberian kuasa, segala akibat hukum dalam pelaksanaan Transaksi Elektronik menjadi tanggung jawab pemberi kuasa; atau
3. jika dilakukan melalui Agen Elektronik, segala akibat hukum dalam pelaksanaan Transaksi Elektronik menjadi tanggung jawab penyelenggara Agen Elektronik.
Jika kerugian Transaksi Elektronik disebabkan gagal beroperasinya Agen Elektronik akibat tindakan pihak ketiga secara langsung terhadap Sistem Elektronik, segala akibat hukum menjadi tanggung jawab penyelenggara Agen Elektronik.
Jika kerugian Transaksi Elektronik disebabkan gagal beroperasinya Agen Elektronik akibat kelalaian pihak pengguna jasa layanan, segala akibat hukum menjadi tanggung jawab pengguna jasa layanan.
Ketentuan sebagaimana dimaksud pada ayat (2) tidak berlaku dalam hal dapat dibuktikan terjadinya keadaan memaksa, kesalahan, dan/atau kelalaian pihak pengguna Sistem Elektronik.

Pasal 22

Penyelenggara Agen Elektronik tertentu harus menyediakan fitur pada Agen Elektronik yang dioperasikannya yang memungkinkan penggunanya melakukan perubahan informasi yang masih dalam proses transaksi.
Ketentuan lebih lanjut mengenai penyelenggara Agen Elektronik tertentu sebagaimana dimaksud pada ayat (1) diatur dengan Peraturan Pemerintah.

BAB VI

NAMA DOMAIN, HAK KEKAYAAN INTELEKTUAL, DAN PERLINDUNGAN HAK PRIBADI

Pasal 23

Setiap penyelenggara negara, Orang, Badan Usaha, dan/atau masyarakat berhak memiliki Nama Domain berdasarkan prinsip pendaftar pertama.
Pemilikan dan penggunaan Nama Domain sebagaimana dimaksud pada ayat (1) harus didasarkan pada iktikad baik, tidak melanggar prinsip persaingan usaha secara sehat, dan tidak melanggar hak Orang lain.
Setiap penyelenggara negara, Orang, Badan Usaha, atau masyarakat yang dirugikan karena penggunaan Nama Domain secara tanpa hak oleh Orang lain, berhak mengajukan gugatan pembatalan Nama Domain dimaksud.

Pasal 24

Pengelola Nama Domain adalah Pemerintah dan/atau masyarakat.
Dalam hal terjadi perselisihan pengelolaan Nama Domain oleh masyarakat, Pemerintah berhak mengambil alih sementara pengelolaan Nama Domain yang diperselisihkan.
Pengelola Nama Domain yang berada di luar wilayah Indonesia dan Nama Domain yang diregistrasinya diakui keberadaannya sepanjang tidak bertentangan dengan Peraturan Perundang-undangan.
Ketentuan lebih lanjut mengenai pengelolaan Nama Domain sebagaimana dimaksud pada ayat (1), ayat (2), dan ayat (3) diatur dengan Peraturan Pemerintah.

Pasal 25

Informasi Elektronik dan/atau Dokumen Elektronik yang disusun menjadi karya intelektual, situs internet, dan karya intelektual yang ada di dalamnya dilindungi sebagai Hak Kekayaan Intelektual berdasarkan ketentuan Peraturan Perundang-undangan.

Pasal 26

Kecuali ditentukan lain oleh Peraturan Perundang-undangan, penggunaan setiap informasi melalui media elektronik yang menyangkut data pribadi seseorang harus dilakukan atas persetujuan Orang yang bersangkutan.
Setiap Orang yang dilanggar haknya sebagaimana dimaksud pada ayat (1) dapat mengajukan gugatan atas kerugian yang ditimbulkan berdasarkan Undang-Undang ini.

BAB VII

PERBUATAN YANG DILARANG

Pasal 27

Setiap Orang dengan sengaja dan tanpa hak mendistribusikan dan/atau mentransmisikan dan/atau membuat dapat diaksesnya Informasi Elektronik dan/atau Dokumen Elektronik yang memiliki muatan yang melanggar kesusilaan.
Setiap Orang dengan sengaja dan tanpa hak mendistribusikan dan/atau mentransmisikan dan/atau membuat dapat diaksesnya Informasi Elektronik dan/atau Dokumen Elektronik yang memiliki muatan perjudian.
Setiap Orang dengan sengaja dan tanpa hak mendistribusikan dan/atau mentransmisikan dan/atau membuat dapat diaksesnya Informasi Elektronik dan/atau Dokumen Elektronik yang memiliki muatan penghinaan dan/atau pencemaran nama baik.
Setiap Orang dengan sengaja dan tanpa hak mendistribusikan dan/atau mentransmisikan dan/atau membuat dapat diaksesnya Informasi Elektronik dan/atau Dokumen Elektronik yang memiliki muatan pemerasan dan/atau pengancaman.

Pasal 28

Setiap Orang dengan sengaja dan tanpa hak menyebarkan berita bohong dan menyesatkan yang mengakibatkan kerugian konsumen dalam Transaksi Elektronik.
Setiap Orang dengan sengaja dan tanpa hak menyebarkan informasi yang ditujukan untuk menimbulkan rasa kebencian atau permusuhan individu dan/atau kelompok masyarakat tertentu berdasarkan atas suku, agama, ras, dan antargolongan (SARA).

Pasal 29

Setiap Orang dengan sengaja dan tanpa hak mengirimkan Informasi Elektronik dan/atau Dokumen Elektronik yang berisi ancaman kekerasan atau menakut-nakuti yang ditujukan secara pribadi.

Pasal 30

Setiap Orang dengan sengaja dan tanpa hak atau melawan hukum mengakses Komputer dan/atau Sistem Elektronik milik Orang lain dengan cara apa pun.
Setiap Orang dengan sengaja dan tanpa hak atau melawan hukum mengakses Komputer dan/atau Sistem Elektronik dengan cara apa pun dengan tujuan untuk memperoleh Informasi Elektronik dan/atau Dokumen Elektronik.
Setiap Orang dengan sengaja dan tanpa hak atau melawan hukum mengakses Komputer dan/atau Sistem Elektronik dengan cara apa pun dengan melanggar, menerobos, melampaui, atau menjebol sistem pengamanan.

Pasal 31

Setiap Orang dengan sengaja dan tanpa hak atau melawan hukum melakukan intersepsi atau penyadapan atas Informasi Elektronik dan/atau Dokumen Elektronik dalam suatu Komputer dan/atau Sistem Elektronik tertentu milik Orang lain.
Setiap Orang dengan sengaja dan tanpa hak atau melawan hukum melakukan intersepsi atas transmisi Informasi Elektronik dan/atau Dokumen Elektronik yang tidak bersifat publik dari, ke, dan di dalam suatu Komputer dan/atau Sistem Elektronik tertentu milik Orang lain, baik yang tidak menyebabkan perubahan apa pun maupun yang menyebabkan adanya perubahan, penghilangan, dan/atau penghentian Informasi Elektronik dan/atau Dokumen Elektronik yang sedang ditransmisikan.
Kecuali intersepsi sebagaimana dimaksud pada ayat (1) dan ayat (2), intersepsi yang dilakukan dalam rangka penegakan hukum atas permintaan kepolisian, kejaksaan, dan/atau institusi penegak hukum lainnya yang ditetapkan berdasarkan undang-undang.
Ketentuan lebih lanjut mengenai tata cara intersepsi sebagaimana dimaksud pada ayat (3) diatur dengan Peraturan Pemerintah.

Pasal 32

Setiap Orang dengan sengaja dan tanpa hak atau melawan hukum dengan cara apa pun mengubah, menambah, mengurangi, melakukan transmisi, merusak, menghilangkan, memindahkan, menyembunyikan suatu Informasi Elektronik dan/atau Dokumen Elektronik milik Orang lain atau milik publik.
Setiap Orang dengan sengaja dan tanpa hak atau melawan hukum dengan cara apa pun memindahkan atau mentransfer Informasi Elektronik dan/atau Dokumen Elektronik kepada Sistem Elektronik Orang lain yang tidak berhak.
Terhadap perbuatan sebagaimana dimaksud pada ayat (1) yang mengakibatkan terbukanya suatu Informasi Elektronik dan/atau Dokumen Elektronik yang bersifat rahasia menjadi dapat diakses oleh publik dengan keutuhan data yang tidak sebagaimana mestinya.

Pasal 33

Setiap Orang dengan sengaja dan tanpa hak atau melawan hukum melakukan tindakan apa pun yang berakibat terganggunya Sistem Elektronik dan/atau mengakibatkan Sistem Elektronik menjadi tidak bekerja sebagaimana mestinya.

Pasal 34

Setiap Orang dengan sengaja dan tanpa hak atau melawan hukum memproduksi, menjual, mengadakan untuk digunakan, mengimpor, mendistribusikan, menyediakan, atau memiliki:
1. perangkat keras atau perangkat lunak Komputer yang dirancang atau secara khusus dikembangkan untuk memfasilitasi perbuatan sebagaimana dimaksud dalam Pasal 27 sampai dengan Pasal 33;
2. sandi lewat Komputer, Kode Akses, atau hal yang sejenis dengan itu yang ditujukan agar Sistem Elektronik menjadi dapat diakses dengan tujuan memfasilitasi perbuatan sebagaimana dimaksud dalam Pasal 27 sampai dengan Pasal 33.
Tindakan sebagaimana dimaksud pada ayat (1) bukan tindak pidana jika ditujukan untuk melakukan kegiatan penelitian, pengujian Sistem Elektronik, untuk perlindungan Sistem Elektronik itu sendiri secara sah dan tidak melawan hukum.

Pasal 35

Setiap Orang dengan sengaja dan tanpa hak atau melawan hukum melakukan manipulasi, penciptaan, perubahan, penghilangan, pengrusakan Informasi Elektronik dan/atau Dokumen Elektronik dengan tujuan agar Informasi Elektronik dan/atau Dokumen Elektronik tersebut dianggap seolah-olah data yang otentik.

Pasal 36

Setiap Orang dengan sengaja dan tanpa hak atau melawan hukum melakukan perbuatan sebagaimana dimaksud dalam Pasal 27 sampai dengan Pasal 34 yang mengakibatkan kerugian bagi Orang lain.

Pasal 37

Setiap Orang dengan sengaja melakukan perbuatan yang dilarang sebagaimana dimaksud dalam Pasal 27 sampai dengan Pasal 36 di luar wilayah Indonesia terhadap Sistem Elektronik yang berada di wilayah yurisdiksi Indonesia.

BAB VIII

PENYELESAIAN SENGKETA

Pasal 38

Setiap Orang dapat mengajukan gugatan terhadap pihak yang menyelenggarakan Sistem Elektronik dan/atau menggunakan Teknologi Informasi yang menimbulkan kerugian.
Masyarakat dapat mengajukan gugatan secara perwakilan terhadap pihak yang menyelenggarakan Sistem Elektronik dan/atau menggunakan Teknologi Informasi yang berakibat merugikan masyarakat, sesuai dengan ketentuan Peraturan Perundang-undangan.

Pasal 39

Gugatan perdata dilakukan sesuai dengan ketentuan Peraturan Perundang-undangan.
Selain penyelesaian gugatan perdata sebagaimana dimaksud pada ayat (1), para pihak dapat menyelesaikan sengketa melalui arbitrase, atau lembaga penyelesaian sengketa alternatif lainnya sesuai dengan ketentuan Peraturan Perundang-undangan.

BAB IX

PERAN PEMERINTAH DAN PERAN MASYARAKAT

Pasal 40

Pemerintah memfasilitasi pemanfaatan Teknologi Informasi dan Transaksi Elektronik sesuai dengan ketentuan Peraturan Perundang-undangan.
Pemerintah melindungi kepentingan umum dari segala jenis gangguan sebagai akibat penyalahgunaan Informasi Elektronik dan Transaksi Elektronik yang mengganggu ketertiban umum, sesuai dengan ketentuan Peraturan Perundang-undangan.
Pemerintah menetapkan instansi atau institusi yang memiliki data elektronik strategis yang wajib dilindungi.
Instansi atau institusi sebagaimana dimaksud pada ayat (3) harus membuat Dokumen Elektronik dan rekam cadang elektroniknya serta menghubungkannya ke pusat data tertentu untuk kepentingan pengamanan data.
Instansi atau institusi lain selain diatur pada ayat (3) membuat Dokumen Elektronik dan rekam cadang elektroniknya sesuai dengan keperluan perlindungan data yang dimilikinya.
Ketentuan lebih lanjut mengenai peran Pemerintah sebagaimana dimaksud pada ayat (1), ayat (2), dan ayat (3) diatur dengan Peraturan Pemerintah.

Pasal 41

Masyarakat dapat berperan meningkatkan pemanfaatan Teknologi Informasi melalui penggunaan dan Penyelenggaraan Sistem Elektronik dan Transaksi Elektronik sesuai dengan ketentuan Undang-Undang ini.
Peran masyarakat sebagaimana dimaksud pada ayat (1) dapat diselenggarakan melalui lembaga yang dibentuk oleh masyarakat.
Lembaga sebagaimana dimaksud pada ayat (2) dapat memiliki fungsi konsultasi dan mediasi.

BAB X

PENYIDIKAN

Pasal 42

Penyidikan terhadap tindak pidana sebagaimana dimaksud dalam Undang-Undang ini, dilakukan berdasarkan ketentuan dalam Hukum Acara Pidana dan ketentuan dalam Undang-Undang ini.

Pasal 43

Selain Penyidik Pejabat Polisi Negara Republik Indonesia, Pejabat Pegawai Negeri Sipil tertentu di lingkungan Pemerintah yang lingkup tugas dan tanggung jawabnya di bidang Teknologi Informasi dan Transaksi Elektronik diberi wewenang khusus sebagai penyidik sebagaimana dimaksud dalam Undang-Undang tentang Hukum Acara Pidana untuk melakukan penyidikan tindak pidana di bidang Teknologi Informasi dan Transaksi Elektronik.
Penyidikan di bidang Teknologi Informasi dan Transaksi Elektronik sebagaimana dimaksud pada ayat (1) dilakukan dengan memperhatikan perlindungan terhadap privasi, kerahasiaan, kelancaran layanan publik, integritas data, atau keutuhan data sesuai dengan ketentuan Peraturan Perundang-undangan.
Penggeledahan dan/atau penyitaan terhadap sistem elektronik yang terkait dengan dugaan tindak pidana harus dilakukan atas izin ketua pengadilan negeri setempat.
Dalam melakukan penggeledahan dan/atau penyitaan sebagaimana dimaksud pada ayat (3), penyidik wajib menjaga terpeliharanya kepentingan pelayanan umum.
Penyidik Pegawai Negeri Sipil sebagaimana dimaksud pada ayat (1) berwenang:
1. menerima laporan atau pengaduan dari seseorang tentang adanya tindak pidana berdasarkan ketentuan Undang-Undang ini;
2. memanggil setiap Orang atau pihak lainnya untuk didengar dan/atau diperiksa sebagai tersangka atau saksi sehubungan dengan adanya dugaan tindak pidana di bidang terkait dengan ketentuan Undang-Undang ini;
3. melakukan pemeriksaan atas kebenaran laporan atau keterangan berkenaan dengan tindak pidana berdasarkan ketentuan Undang-Undang ini;
4. melakukan pemeriksaan terhadap Orang dan/atau Badan Usaha yang patut diduga melakukan tindak pidana berdasarkan Undang-Undang ini;
5. melakukan pemeriksaan terhadap alat dan/atau sarana yang berkaitan dengan kegiatan Teknologi Informasi yang diduga digunakan untuk melakukan tindak pidana berdasarkan Undang-Undang ini;
6. melakukan penggeledahan terhadap tempat tertentu yang diduga digunakan sebagai tempat untuk melakukan tindak pidana berdasarkan ketentuan Undang-Undang ini;
7. melakukan penyegelan dan penyitaan terhadap alat dan atau sarana kegiatan Teknologi Informasi yang diduga digunakan secara menyimpang dari ketentuan Peraturan Perundang-undangan;
8. meminta bantuan ahli yang diperlukan dalam penyidikan terhadap tindak pidana berdasarkan Undang-Undang ini; dan/atau
9. mengadakan penghentian penyidikan tindak pidana berdasarkan Undang-Undang ini sesuai dengan ketentuan hukum acara pidana yang berlaku.

Dalam hal melakukan penangkapan dan penahanan, penyidik melalui penuntut umum wajib meminta penetapan ketua pengadilan negeri setempat dalam waktu satu kali dua puluh empat jam.
Penyidik Pegawai Negeri Sipil sebagaimana dimaksud pada ayat (1) berkoordinasi dengan Penyidik Pejabat Polisi Negara Republik Indonesia memberitahukan dimulainya penyidikan dan menyampaikan hasilnya kepada penuntut umum.
Dalam rangka mengungkap tindak pidana Informasi Elektronik dan Transaksi Elektronik, penyidik dapat berkerja sama dengan penyidik negara lain untuk berbagi informasi dan alat bukti.

Pasal 44

Alat bukti penyidikan, penuntutan dan pemeriksaan di sidang pengadilan menurut ketentuan Undang-Undang ini adalah sebagai berikut:

alat bukti sebagaimana dimaksud dalam ketentuan Perundang-undangan; dan
alat bukti lain berupa Informasi Elektronik dan/atau Dokumen Elektronik sebagaimana dimaksud dalam Pasal 1 angka 1 dan angka 4 serta Pasal 5 ayat (1), ayat (2), dan ayat (3).

BAB XI

KETENTUAN PIDANA

Pasal 45

Setiap Orang yang memenuhi unsur sebagaimana dimaksud dalam Pasal 27 ayat (1), ayat (2), ayat (3), atau ayat (4) dipidana dengan pidana penjara paling lama 6 (enam) tahun dan/atau denda paling banyak Rp1.000.000.000,00 (satu miliar rupiah).
(2) Setiap Orang yang memenuhi unsur sebagaimana dimaksud dalam Pasal 28 ayat (1) atau ayat (2) dipidana dengan pidana penjara paling lama 6 (enam) tahun dan/atau denda paling banyak Rp1.000.000.000,00 (satu miliar rupiah).
(3) Setiap Orang yang memenuhi unsur sebagaimana dimaksud dalam Pasal 29 dipidana dengan pidana penjara paling lama 12 (dua belas) tahun dan/atau denda paling banyak Rp2.000.000.000,00 (dua miliar rupiah).

Pasal 46

Setiap Orang yang memenuhi unsur sebagaimana dimaksud dalam Pasal 30 ayat (1) dipidana dengan pidana penjara paling lama 6 (enam) tahun dan/atau denda paling banyak Rp600.000.000,00 (enam ratus juta rupiah).
Setiap Orang yang memenuhi unsur sebagaimana dimaksud dalam Pasal 30 ayat (2) dipidana dengan pidana penjara paling lama 7 (tujuh) tahun dan/atau denda paling banyak Rp700.000.000,00 (tujuh ratus juta rupiah).
Setiap Orang yang memenuhi unsur sebagaimana dimaksud dalam Pasal 30 ayat (3) dipidana dengan pidana penjara paling lama 8 (delapan) tahun dan/atau denda paling banyak Rp800.000.000,00 (delapan ratus juta rupiah).

Pasal 47

Setiap Orang yang memenuhi unsur sebagaimana dimaksud dalam Pasal 31 ayat (1) atau ayat (2) dipidana dengan pidana penjara paling lama 10 (sepuluh) tahun dan/atau denda paling banyak Rp800.000.000,00 (delapan ratus juta rupiah).

Pasal 48

Setiap Orang yang memenuhi unsur sebagaimana dimaksud dalam Pasal 32 ayat (1) dipidana dengan pidana penjara paling lama 8 (delapan) tahun dan/atau denda paling banyak Rp2.000.000.000,00 (dua miliar rupiah).
Setiap Orang yang memenuhi unsur sebagaimana dimaksud dalam Pasal 32 ayat (2) dipidana dengan pidana penjara paling lama 9 (sembilan) tahun dan/atau denda paling banyak Rp3.000.000.000,00 (tiga miliar rupiah).
Setiap Orang yang memenuhi unsur sebagaimana dimaksud dalam Pasal 32 ayat (3) dipidana dengan pidana penjara paling lama 10 (sepuluh) tahun dan/atau denda paling banyak Rp5.000.000.000,00 (lima miliar rupiah).

Pasal 49

Setiap Orang yang memenuhi unsur sebagaimana dimaksud dalam Pasal 33, dipidana dengan pidana penjara paling lama 10 (sepuluh) tahun dan/atau denda paling banyak Rp10.000.000.000,00 (sepuluh miliar rupiah).

Pasal 50

Setiap Orang yang memenuhi unsur sebagaimana dimaksud dalam Pasal 34 ayat (1) dipidana dengan pidana penjara paling lama 10 (sepuluh) tahun dan/atau denda paling banyak Rp10.000.000.000,00 (sepuluh miliar rupiah).

Pasal 51

Setiap Orang yang memenuhi unsur sebagaimana dimaksud dalam Pasal 35 dipidana dengan pidana penjara paling lama 12 (dua belas) tahun dan/atau denda paling banyak Rp12.000.000.000,00 (dua belas miliar rupiah).
Setiap Orang yang memenuhi unsur sebagaimana dimaksud dalam Pasal 36 dipidana dengan pidana penjara paling lama 12 (dua belas) tahun dan/atau denda paling banyak Rp12.000.000.000,00 (dua belas miliar rupiah).

Pasal 52

Dalam hal tindak pidana sebagaimana dimaksud dalam Pasal 27 ayat (1) menyangkut kesusilaan atau eksploitasi seksual terhadap anak dikenakan pemberatan sepertiga dari pidana pokok.
Dalam hal perbuatan sebagaimana dimaksud dalam Pasal 30 sampai dengan Pasal 37 ditujukan terhadap Komputer dan/atau Sistem Elektronik serta Informasi Elektronik dan/atau Dokumen Elektronik milik Pemerintah dan/atau yang digunakan untuk layanan publik dipidana dengan pidana pokok ditambah sepertiga.
Dalam hal perbuatan sebagaimana dimaksud dalam Pasal 30 sampai dengan Pasal 37 ditujukan terhadap Komputer dan/atau Sistem Elektronik serta Informasi Elektronik dan/atau Dokumen Elektronik milik Pemerintah dan/atau badan strategis termasuk dan tidak terbatas pada lembaga pertahanan, bank sentral, perbankan, keuangan, lembaga internasional, otoritas penerbangan diancam dengan pidana maksimal ancaman pidana pokok masing-masing Pasal ditambah dua pertiga.
Dalam hal tindak pidana sebagaimana dimaksud dalam Pasal 27 sampai dengan Pasal 37 dilakukan oleh korporasi dipidana dengan pidana pokok ditambah dua pertiga.

BAB XII

KETENTUAN PERALIHAN

Pasal 53

Pada saat berlakunya Undang-Undang ini, semua Peraturan Perundang-undangan dan kelembagaan yang berhubungan dengan pemanfaatan Teknologi Informasi yang tidak bertentangan dengan Undang-Undang ini dinyatakan tetap berlaku.

BAB XIII

KETENTUAN PENUTUP

Pasal 54

Undang-Undang ini mulai berlaku pada tanggal diundangkan.
Peraturan Pemerintah harus sudah ditetapkan paling lama 2 (dua) tahun setelah diundangkannya Undang-Undang ini.

Agar setiap orang mengetahuinya, memerintahkan pengundangan Undang-Undang ini dengan penempatannya dalam Lembaran Negara Republik Indonesia.

I am a geek in technology. In many cases I see loads of problems in my clients computer is virus. Mostly because of the Antivirus is not updated regularly. This is the common mistake all computer user do. They think when they have installed the anti virus then all the virus will be gone.

PENDIDIKAN YANG MENJADI BOOMERANG.

Seorang teman saya yang bekerja pada sebuah perusahaan asing, di PHK akhir tahun lalu. Penyebabnya adalah kesalahan menerapkan dosis pengolahan limbah, yang telah berlangsung bertahun-tahun. Kesalahan ini terkuak ketika seorang pakar limbah dari suatu negara Eropa mengawasi secara langsung proses pengolahan limbah yang selama itu dianggap selalu gagal.

Pasalnya adalah, takaran timbang yang dipakai dalam buku petunjuknya menggunakan satuan pound dan ounce. Kesalahan fatal muncul karena yang bersangkutan mengartikan 1 pound = 0,5 kg. dan 1 ounce (ons) = 100 gram, sesuai pelajaran yang ia terima dari sekolah.

Sebelum PHK dijatuhkan, teman saya diberi tenggang waktu 7 hari untuk membela diri dgn. cara menunjukkan acuan ilmiah yang menyatakan 1 ounce (ons) = 100 g. Usaha maksimum yang dilakukan hanya bisa menunjukkan Kamus Besar Bahasa Indonesia yang mengartikan ons (bukan ditulis ounce) adalah satuan berat senilai 1/10 kilogram. Acuan lain termasuk tabel-tabel konversi yang berlaku sah atau dikenal secara internasional tidak bisa ditemukan.

SALAH KAPRAH YANG TURUN-TEMURUN.

Prihatin dan penasaran atas kasus diatas, saya mencoba menanyakan hal ini kepada lembaga yang paling berwenang atas system takar-timbang dan ukur di Indonesia , yaitu Direktorat Metrologi. Ternyata, pihak Dir. Metrologi pun telah lama melarang pemakaian satuan ons untuk ekivalen 100 gram. Mereka justru mengharuskan pemakaian satuan yang termasuk dalam Sistem Internasional (metrik) yang diberlakukan resmi di Indonesia. Untuk ukuran berat, satuannya adalah gram dan kelipatannya.

Satuan *Ons bukanlah bagian dari sistem metrik* ini dan untuk menghilangkan kebiasaan memakai satuan ons ini, Direktorat Metrologi sejak lama telah memusnahkan semua anak timbangan (bandul atau timbal) yang bertulisan “ons” dan “pound”.

Lepas dari adanya kebiasaan kita mengatakan 1 ons = 100 gram dan 1 pound = 500 gram, ternyata *tidak pernah ada acuan system
takar-timbang legal* atau pengakuan internasional atas satuan ons yang nilainya setara dengan 100 gram. Dan dalam sistem timbangan legal yang diakui dunia internasional, *tidak pernah dikenal adanya satuan ONS khusus ** Indonesia **.

Jadi, hal ini adalah suatu kesalahan yang diwariskan turun-temurun.
Sampai kapan mau dipertahankan ?

BAGAIMANA KESALAHAN DIAJARKAN SECARA RESMI ?

Saya sendiri pernah menerima pengajaran salah ini ketika masih dibangku sekolah dasar. Namun, ketika saya memasuki dunia kerja nyata, kebiasaan salah yang nyata-nyata diajarkan itu harus dibuang jauh karena akan menyesatkan

Beberapa sekolah telah saya datangi untuk melihat sejauh mana penyadaran akan penggunaan sistem takar-timbang yang benar dan
sah dikemas dalam materi pelajaran secara benar, dan bagaimana para murid (anak-anak kita) menerapkan dalam hidup sehari-hari.

Sungguh memprihatinkan.

Semua sekolah mengajarkan bahwa 1 ons = 100 gram dan 1 pound = 500 gram, dan anak-anak kita pun menggunakannya dalam kegiatan sehari-hari. “Racun” ini sudah tertanam didalam otak anak kita sejak usia dini.

Dari para guru, saya mendapatkan penjelasan bahwa semua buku pegangan yang diwajibkan atau disarankan oleh Departemen
Pendidikan Indonesia mengajarkan seperti itu. Karena itu, tidaklah mungkin Bagi para guru untuk melakukan koreksi selama Dep. Pendidikan belum merubah atau memberikan petunjuk resmi.

TANGGUNG JAWAB SIAPA ?

Maka, bila terjadi kasus-kasus serupa diatas, Departemen Pendidikan kita jangan lepas tangan. Tunjukkanlah kepada masyarakat kita terutama kepada para guru Yang mengajarkan kesalahan ini, salah satu alasannya agar tidak menjadi beban psikologis bagi mereka; *”acuan sistem timbang legal yang mana yang pernah diakui/ diberlakukan secara internasional, yang menyatakan bahwa : **1 ons adalah 100 gram, 1 pound adalah 500 gram.”?*

Kalau Dep. Pendidikan tidak bisa menunjukkan acuannya, mengapa hal ini diajarkan secara resmi di sekolah sampai sekarang ?
Pernahkan Dep. Pendidikan menelusuri, di negara mana saja selain Indonesia berlaku konversi 1 ons = 100 gram dan 1 pound = 500 gram? Patut dipertanyakan pula, bagaimana tanggung jawab para penerbit buku pegangan sekolah yang melestarikan kesalahan ini?

Kalau Dep. Pendidikan mau mempertahankan satuan *ons yang keliru* ini, sementara pemerintah sendiri melalui Direktorat
Metrologi melarang pemakaian satuan “ons” dalam transaksi legal, maka konsekwensinya ialah harus dibuat sistem baru timbangan Indonesia (versi Depdiknas).

Sistem baru inipun harus diakui lebih dulu oleh dunia internasional sebelum diajarkan kepada anak-anak. Perlukah adanya system timbangan Indonesia yang konversinya adalah 1 ons *(Depdiknas) * = 100 gram Dan 1 pound *(Depdiknas) * = 500 gram.?

Bagaimana “Ons dan Pound *(Depdiknas) *” ini dimasukkan dalam sistem metric yang sudah baku diseluruh dunia? Siapa yang mau pakai?.

HENTIKAN SEGERA KESALAHAN INI.

Contoh kasus diatas hanyalah satu diantara sekian banyak problema yang merupakan akibat atau korban kesalahan pendidikan. Saya yakin masih banyak kasus-kasus senada yang terjadi, tetapi tidak kita dengar. Salah satu contoh kecil ialah, banyak sekali ibu-ibu yang mempraktekkan resep kue dari buku luar negeri tidak berhasil tanpa diketahui dimana kesalahannya.

Karena ini kesalahan pendidikan, masalah ini sebenarnya merupakan masalah nasional pendidikan kita yang mau tidak mau harus segera dihentikan.

Departemen Pendidikan tidak perlu malu dan basa-basi diplomatis mengenai hal ini. Mari kita pikirkan dampaknya bagi masa depan anak-anak Indonesia . Berikan teladan kepada bangsa ini untuk tidak malu memperbaiki kesalahan.

Sekalipun hanya untuk pelajaran di sekolah, dalam hal Takar-Timbang- Ukur, Dep. Pendidikan tidak memiliki supremasi sedikitpun terhadap Direktorat Metrologi sebagai lembaga yang paling berwenang di Indonesia . Mari kitam ikuti satu acuan saja, yaitu Direktorat Metrologi.

Era Globalisasi tidak mungkin kita hindari, dan karena itu anak-anak kita harus dipersiapkan dengan benar. Benar dalam arti landasannya, prosesnya, materinya maupun arah pendidikannya. Mengejar ketertinggalan dalam hal kualitas SDM negara tetangga saja sudah merupakan upaya yang sangat berat.

Janganlah malah diperberat dengan *pelajaran sampah* yang justru bakal menyesatkan. Didiklah anak-anak kita untuk mengenal dan mengikuti aturan dan standar yang berlaku SAH dan DIAKUI secara internasional, bukan hanya yang rekayasa lokal saja. Jangan ada lagi korban akibat pendidikan yang salah. Kita lihat yang nyata saja, berapa banyak TKI diluar negeri yang berarti harus mengikuti acuan yang berlaku secara internasional.

Anak-anak kita memiliki HAK untuk mendapatkan pendidikan yang benar sebagai upaya mempersiapkan diri menyongsong masa depannya yang akan penuh dengan tantangan berat.

ACUAN MANA YANG BENAR?

Banyak sekali literatur, khususnya yang dipakai dalam dunia tehnik, dan juga ensiklopedi ternama seperti Britannica, Oxford , dll. *(maaf, ini bukan promosi)* menyajikan tabel-tabel konversi yang tidak perlu diragukan lagi.

Selain pada buku literatur, tabel-tabel konversi semacam itu Dapat dijumpai dengan mudah di-dalam buku harian/diary/ agenda
yang biasanya diberikan oleh toko atau produsen suatu produk sebagai sarana promosi.

*Salah satu* konversi untuk satuan berat yang umum dipakai SAH secara internasional adalah sistem avoirdupois/ avdp. (baca : averdupoiz).

1 ounce/ons/onza = 28,35 gram *(bukan 100 g.)*

1 pound = 453 gram *(bukan 500 g.)*

1 pound = 16 ounce *(bukan 5 ons)*

Bayangkan saja, bagaimana jadinya kalau seorang apoteker meracik resep obat yang seharusnya hanya diberi 28 gram, namun diberi 100 gram. Apakah kesalahan semacam ini bisa di kategorikan sebagai malapraktek?

Pelajarannya memang begitu, kalau murid tidak mengerti, dihukum!!!

Jadi, kalau malapraktik, logikanya adalah tanggung jawab yang mengajarkan. (*ini hanyagambaran/ ilustrasi salah satu akibat yang bisa ditimbulkan, bukan kejadian sebenarnya, tetapi dalam bidang lain banyak sekali terjadi)*

KALAU BUKAN KITA YANG MENYELAMATKAN – LALU SIAPA ?

Melalui tulisan ini saya ingin mengajak semua kalangan, baik kalangan pemerintah, akademis, profesi, bisnis/pedagang, sekolah dan orang tua dan juga yang lainnya untuk ikut serta mendukung penghapusan satuan “ons dan pound yang keliru” dari kegiatan kita sehari-hari.
Pengajaran sistem timbang dgn. satuan Ounce dan Pound seharusnya diberikan sebagai pengetahuan disertai kejelasan asal-usul serta *rumus konversi yang benar*. Hal ini untuk membuang kebiasaan salah yang telah melekat dalam kebiasaan kita, yang bisa
mencelakakan/ menyesatkan anak-anak kita, generasi penerus bangsa ini

Dalam sistem metrik memang dikenal *1 are = 100 m2* khusus untuk ukuran tanah yang diakui sah secarainternasional.

*Untuk satuan ONS yang mengartikan kelipatan 100 g., apalagi POUND yang mengartikan kelipatan 500 g., tidak pernah ada didalam system metrik maupun non-metrik/imperial yang pernah diberlakukan sah secara internasional.
